Terms of Use
The “NWI EC Mall Terms of Use” (hereinafter referred to as the “Terms”) are set forth by NIPPON WAGYU INTERNATIONAL Co., Ltd. (hereinafter referred to as the “Company”) hereby establishes the “NWI EC Mall Terms of Service” (hereinafter referred to as the “Terms of Service”). The “NWI EC Mall Terms of Service” (hereinafter referred to as the “Terms”) is a set of terms and conditions governing the use of the service (hereinafter referred to as the “Service”) operated by NIPPON WAGYU INTERNATIONAL Co., Ltd. The “Terms and Conditions of Use” (hereinafter referred to as the “Terms and Conditions”) shall be governed by the Terms and Conditions between the customer (hereinafter referred to as the “Customer”) specified in Article 1.3 of these Terms and Conditions and the Company. The Service is a service that is provided in Article 1.1 of these Terms of Use (hereinafter referred to as the “Service”).
You must comply with these Terms of Use when using the Service.
Article 1 Definitions
(1)“Service” means a service for customers departing from Japan (Kansai International Airport) and entering the Republic of Singapore, whereby the company
acts as an agent for export quarantine and other procedures for the Product as set forth in the following item, thereby enabling the Product to be carried back as Passenger's Carry-on Goods.
(2) “Product” means Wagyu beef sold by the Company.
(3) “Customer” means a person who departs from Japan (Kansai International Airport) and enters the Republic of Singapore by an international flight.
Article 2 Agreement and Modification of Terms and Conditions
(1) In using the Service, the Customer agrees to abide by the Terms and Conditions (including the Privacy Policy and other terms and conditions related to the Terms and Conditions; the same shall apply hereinafter).
(2) If you are a minor (under 18 years of age), you must obtain the consent of a legal representative such as a person with parental authority before using the Service, and by starting to use the Service, you are deemed to have obtained the consent of the legal representative such as a person with parental authority.
(3) Even if any part of these Terms and Conditions is determined to be invalid under laws and regulations, etc., the provisions other than the invalidated part shall remain in effect, and the customer's consent to the invalidated part shall also remain in effect.
(4) The Company may change the Terms at any time as necessary, and the Company shall specify the effective date of such change, and shall notify the Customer of the change, the content of the revised Terms, and the effective date of such change prior to the effective date, by notice on the Service or by any other method the Company deems appropriate.
(5) Continued use of the Service by a customer after a change in the Terms of Service shall be deemed to constitute consent to the change in the Terms of Service.
Article 3 Use of the Service
1. In order to use the Service, the customer must enter or register the necessary information. The customer must ensure that the information entered or registered is correct, and the Company shall not be liable for any damage or disadvantage to the customer due to errors in such information. In the event that the Company deems any of the following to apply, the Company may, without prior notice to the customer, suspend use of all or part of the Service, cancel the purchase agreement for the Product, or take any other necessary action.
(1) If there is an error in the input information and the customer cannot be contacted.
(2) If you are an anti-social force such as a crime syndicate or have a close relationship with such a person
(3) If you are insolvent or we deem you to be insolvent
(4) If you have violated these Terms of Use in the past and have been suspended from using the Service
(5) If you do not have the ability to perform legal acts effectively
(6) If there is a request from a settlement service provider, etc. to suspend the customer's use of the Service
(7) If the settlement service provider, etc. takes measures to suspend the use of settlement or collection agency services.
2. In using the Service, you shall prepare the necessary communication environment and terminal equipment at your own responsibility and expense, and we shall not be liable for any matters arising from such preparation. 3.
3. You shall use the Services at your own discretion, responsibility, and expense.
4. In using the Service, customers shall bear the price of Products, etc., consumption tax, delivery charges, handling charges by payment method, etc., but shall not incur any other fees for using the Service. However, if there are stipulations on the detailed pages of individual Products, etc., the Company shall comply with such stipulations.
5. In the event that the Company determines that a customer falls under the category of anti-social forces such as organized crime groups, persons having close relationships with such persons, or persons similar thereto, the Company may suspend use of the Service without prior notice to the customer.
6. The Company may terminate or change all or part of the Service at any time at its discretion.
7. In the event of force majeure such as natural disasters or other circumstances deemed necessary by the Company, the Company may cancel all or part of the Service by giving prior notice to you. However, in the event of an emergency, prior notice to the customer may be omitted.
8. The customer agrees that the provision of all or part of the Service may be suspended or cancelled due to system failure, force majeure such as natural disasters, or other circumstances deemed necessary by the settlement service provider, etc.
9. The Company shall not be liable for any damage or disadvantage incurred by the customer as a result of the preceding four clauses.
Article 4 Purchase and Payment of Products
1.A customer shall apply for the purchase of the Product via an Internet connection. After the application is received by the Company's server, the details of the application shall be recorded in the Company's system, and a purchase agreement for the Product shall be formed when the Company sends a notice of acceptance in a manner determined by the Company. The Company shall not be liable for any damage or disadvantage incurred by the customer as a result of the contents of the application by the customer not being recorded in the Company's system.
2. Ownership and risk of the Products purchased by the Customer shall be transferred to the Customer at the time of delivery of said Products to the Customer. Except as otherwise provided in these Terms and Conditions, we shall not be liable for any event that occurs after the transfer of ownership.
Article 5 Cancellation by Customer
1. If you wish to terminate (cancel) the purchase contract for the Product after purchase, you must cancel (cancel) in the manner prescribed by the company at least 48 hours prior to the departure time of your flight (the scheduled departure time on the timetable; the same shall apply hereinafter in this Article). The company shall not accept any cancellation by you less than 48 hours prior to the departure time of your flight.
2. In the event of cancellation (cancellation) by the customer less than 48 hours prior to the departure time of the boarding flight or in the event that the customer has not received the Product by the departure time of the boarding flight, the Company shall charge 100% of the reservation fee as a cancellation (cancellation) fee. In such a case, since the export procedures for the Product have been completed, the Company may dispose of the Product without the Customer's consent.
Article 6 Handling in the Event of Flight Cancellation
1. If your flight is cancelled due to force majeure, such as bad weather or an accident, and you are unable to use the Service, we will consider the following measures
(1) If you contact us promptly, we will check the situation and reschedule your flight to another date.
(2) We may ask you to submit a certificate of flight cancellation from the airline company. 2.
2. The preceding paragraph shall apply at the discretion of the Company.
Article 7 Cancellation of Contract by the company
In the event that a customer falls under any of the items of Article 3.1 or Article 8.1, the Company may cancel the sales contract for this product.
Article 8 Prohibited Acts
1. the Company shall prohibit the following acts (hereinafter referred to as “Prohibited Acts”) by you in using the Service The Company prohibits the following acts (hereinafter referred to as “Prohibited Acts”) in the use of the Service by customers.
(1) Violating these Terms of Service or laws and regulations
(2) False registration, lending an account to a third party, or using a third party's account
(3) Purchase of the Products for purposes other than personal consumption
(4) Actions that are detrimental to public order or good morals
(5) Infringing the rights of a third party, slandering or defaming the Company or a third party, defaming the reputation or credibility of the Company or a third party, or otherwise interfering with the Company's business
(6) Use of this service for advertising activities, etc.
(7) Making an unsolicited offer with no intention of conducting a transaction, or purchasing goods or services without having the funds to pay for the goods or services
(8) spreading false information, using deception or force, making unreasonable demands beyond the scope of legal responsibility, or using violent or threatening language or actions
(9) Any act that interferes with the Company's servers or network system.
2. If the Company determines that a customer has committed or is likely to commit any of the prohibited acts listed in the preceding items, the Company may suspend the customer's use of the Service without prior notice to the customer (including cancellation of a purchase agreement, cancellation of an application, or any other action deemed necessary by the Company). In this case, the Company shall not be liable for any damage incurred by the customer.
Article 9 Handling of Personal Information
1. We will appropriately handle customers' personal information related to the use of the Service in accordance with the Privacy Policy stipulated by us.
2. We may disclose your registration information, transaction history, and other information necessary for investigation of abuse of the Service and criminal investigation to settlement providers, collection agencies, victims of abuse, and investigative agencies, as necessary.
Article 10 Disclaimer
1. We make no warranty, express or implied, that the Service is free from defects, errors or bugs, or infringements of rights related to factual or legal defects, safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or security, etc., or the quality, function, or compatibility of the Products with other products.
2. Even if the Company's exemption from liability is limited by the Consumer Contract Act or other applicable laws and regulations, the Company's liability for damages incurred by the customer due to reasons attributable to the Company shall be limited to the price of the Products or 10,000 yen, whichever is lower.
Article 11 Means of Communication
1. If the company deems it necessary to notify or contact you, The company will notify or contact you in a manner it deems appropriate. You agree that the Company may use your registration information for the purpose of such notification or communication.

Article 12 Governing Law and Jurisdiction
1. These Terms of Use shall be governed by and construed in accordance with the laws of Japan.
2. The Osaka Summary Court or the Osaka District Court shall have exclusive jurisdiction in the first instance over any dispute arising between the Company and the customer, depending on the amount of the suit.
